Video Submission Terms & Conditions

By submitting video content through the Dark Entertainment video submission form, you agree to enter into a legally binding agreement with Dark Studios UG (haftungsbeschränkt) under the following terms and conditions regarding the specific video(s) you submit:

1. Grant of License

By submitting your video(s) through the Dark Entertainment submission form, you grant Dark Studios UG (haftungsbeschränkt) ("Dark Studios", "we", "us") a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use the specific video(s) you submit as follows:

• Upload, publish, and distribute the submitted video(s) on YouTube and other platforms
• Modify, edit, cut, and create derivative works from the submitted video(s)
• Use the submitted video(s) for commercial purposes, including but not limited to monetization, advertising, and promotional activities
• Sublicense the rights granted herein to third parties with respect to your submitted video(s)
• Use the submitted video(s) in any media format and through any distribution channel, now known or hereafter developed

This license applies specifically to the video(s) you submit through the Dark Entertainment submission form, including all video content, titles, descriptions, and associated materials you provide. You retain all rights to use your submitted video(s) yourself.

2. Rights and Ownership

With respect to the specific video(s) you submit through the Dark Entertainment submission form to Dark Studios UG (haftungsbeschränkt), you represent and warrant that:

• You are the sole owner of all rights, title, and interest in the video(s) you submit, OR
• You have obtained all necessary permissions, licenses, and consents from all third parties whose content appears in your submitted video(s), including but not limited to:
  • Music rights holders
  • Image and graphics copyright owners
  • Any persons appearing in your submitted video(s)
  • Any other copyrighted material or intellectual property contained in your submitted video(s)
• You have the full legal right, power, and authority to grant the license described herein for the video(s) you submit
• The video(s) you submit do not infringe upon any third-party rights, including copyright, trademark, privacy, or publicity rights

3. Moral Rights Waiver

With respect to the video(s) you submit, to the extent legally permissible under applicable law, you waive any and all moral rights, including but not limited to:

• The right to be identified as the author of the submitted video(s)
• The right to object to derogatory treatment of the submitted video(s)
• Any similar rights recognized under applicable copyright laws regarding your submitted video(s)

Important Legal Note: Under German copyright law (§ 29 UrhG), moral rights (Urheberpersönlichkeitsrechte) cannot be fully waived or transferred. However, you agree to the following:

• You will not exercise your moral rights in a manner that would interfere with or restrict Dark Studios UG (haftungsbeschränkt)'s use of the video(s) you submit as described in these terms
• You consent to modifications, edits, and derivative works of your submitted video(s) as permitted under Section 1
• You agree not to object to the publication, distribution, or commercial use of the submitted video(s) by Dark Studios UG (haftungsbeschränkt)
• The license granted herein is irrevocable to the maximum extent permitted by law, including with respect to moral rights

This agreement is subject to the mandatory provisions of German copyright law that protect moral rights, but you agree to exercise such rights only in accordance with the terms set forth herein.

4. Non-Exclusivity and Your Rights

The license granted herein to Dark Studios UG (haftungsbeschränkt) for the video(s) you submit is non-exclusive, meaning:

• You retain all rights, title, and interest in your submitted video(s)
• You may continue to use your submitted video(s) in any manner you choose, including but not limited to publishing, distributing, modifying, and monetizing them on any platform
• You may grant the same or similar rights to your submitted video(s) to any other party
• You may use the submitted video(s) in any manner, including in ways that may compete with Dark Studios UG (haftungsbeschränkt)'s use
• Dark Studios UG (haftungsbeschränkt) has the right to publish and monetize the video(s) you submit on the specified platforms, including but not limited to the YouTube channel "Dark Entertainment", but this does not prevent you from doing the same

You maintain full ownership and control over your submitted video(s) and may use them as you see fit, while also granting Dark Studios UG (haftungsbeschränkt) the rights described in Section 1.

5. Indemnification

You agree to indemnify, defend, and hold harmless Dark Studios UG (haftungsbeschränkt), its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your breach of any representation, warranty, or covenant contained in these terms regarding the video(s) you submit
• Any claim that the video(s) you submit infringe upon any third-party rights
• Any false or inaccurate information provided by you in connection with your video submission
• Your violation of any applicable laws or regulations in connection with the submitted video(s)

6. No Obligation to Publish

Dark Studios UG (haftungsbeschränkt) reserves the right, in its sole discretion, to:

• Accept or reject the video(s) you submit
• Modify, edit, or not publish your submitted video(s)
• Remove any published version of your submitted video(s) from the Dark Entertainment YouTube channel or any other platform at any time without notice

Submission of your video(s) through the Dark Entertainment form does not create any obligation on Dark Studios UG (haftungsbeschränkt)'s part to publish or use the submitted video content.

7. Accuracy of Information

You confirm that all information provided in connection with your video submission, including but not limited to:

• Your legal name
• Email address
• YouTube channel information
• Video titles, descriptions, and links
• Publication dates

is accurate, complete, and truthful. Providing false information may result in legal consequences and termination of any agreement.

8. Privacy and Data Protection

Your submission and personal data will be processed by Dark Studios UG (haftungsbeschränkt) in accordance with our Privacy Policy and applicable data protection laws, including the GDPR.

9. Governing Law and Jurisdiction

These terms and conditions are governed by and construed in accordance with German law. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of Germany.

10. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

11. Entire Agreement

These terms, together with our General Terms & Conditions and Privacy Policy, constitute the entire agreement between you and Dark Studios UG (haftungsbeschränkt) regarding video submissions to the Dark Entertainment YouTube channel.

12. Modifications

Dark Studios UG (haftungsbeschränkt) reserves the right to modify these terms at any time. Material changes will be communicated through our website. Continued submission of videos after such modifications constitutes acceptance of the updated terms.
